well as some of you know i had got a chevy 2500HD D/A. well on monday i had money put on saying it is mine. so they sent over gmac finacing and all that good stuff. but on tuesday we had a snow storm so i could not pick up the truck till thursday. so on thursday in the morning the guy called say they had sold it!!! i was ****ED! so he he said they could get another one just like it but it had cloth but he said he could change the seats to leather but they would not match. so we said no and i went over to james wood gmc. i talked a deal. he gave me one and 2 hours later i drove out in a new 2002 GMC 2500HD D/A 4X4 SLT fire red with leather bucket seats graphite interior. it can with nerf bars, a bed cover, tool box, a bed extender,pine stripe,and side protector thing that goes on my door. i am very happy the deal did not work out becuase i am friving a better truck and loving every second in it.
today (saterday) i went over there to get the money back and they wont give it to me! what a bunch of jack a$$'s

They sold your truck, deals off plain and simple. You will get your money back. Talk to the sales manager or owner make it plain you will raise the biggest stink known to mankind if they don't fork over the dough. Good Luck

^...Small Claims court. For less than dollars 50, you can file a claim, no lawyer required (at this point), additionally, sue for the fee of the claim and that will get your money back. Where do these jack-asses come from, anyway?

If you have your deposit on a credit card (hopefully!!!!) call them and cancel the charge. I had the same problem when I was buying my truck. It took 3 months to get the charge removed but it got done, minimal hassle. The funny part was that I had $250.00 cash in my pocket that I was going to give to the salesman and manager to split for the little inconvenience that I caused but the manager started acting like an arsehole so I flashed the cash, told him to violate himself and left. The bottomline is if you do not take delivery on a vehicle, they cannot retain your deposit.... Its just amazing to me that people are so stupid, The dealer I had the problem with (Gearhardt Chevy) now lost any chance with me ever purchasing a vehicle from them, the bad words that I tell everybody I know about them, and the future service that I may go to them for. The really sad part is that I would rather purchase the vehicle from them because they have a free car wash there. All that over a deposit that they cannot legally keep. VERY STUPID !!!!

Not knowing all the details and assuming what you said was true (no misccommunication etc), here's what I would do:
I would drive my new truck to the dealer, park right up front to show selling dealers tailgate sticker, and have a visit with the owner or GM. I would explain what happened and let him sort out the details. You should walk out with a check, and hopefully (again details unknown) the sales preson should get a swift kick in the hiner!
Was there a sales contract written or a receipt given???

Dig out your owners manual. There is a complaint process for you to follow. Generally it's for mechanical, etc. problems but I would give it a try. GM is GM and mabye someone at the regional level can have a talk with the people (term used loosely) at Para.

Grab a phone book and see if they list an area rep for GM. Sometimes they do. Talk to them and then explain that the law suit will not only be against the dealer but will include GM.
And that you will make sure it becomes very news worthy. And I am sure Dallas, like Houston, has a bunch of news people that fight as consumer advocates. All kinds of fun things to do to them.
Worked for me once. Had a check in 2 days.
Crap like this should be criminal. And it could be if they illegally try and keep your money.

After trying all the nice stuff, I think I would tell them that if I did not get my $$ ASAP, I would soon be part owner in their business. Add to it that not only would I sue them for selling my truck, but also sue the salesman, GM, and owners PERSONALY.

I think were missing some info here!! Why did they sell the truck you ordered, and had a deposit on? How much money did you put down?
The only reason, that I can see that they can keep your deposit would be if you DID NOT want the truck when it came in. DID you want it?
If this isn't the case, then there should be no reason for them keeping the deposit. Why are they being so animate with keeping the money???

I don't believe they can keep your deposit even if you ordered it then changed your mind when it came in. As long as you don't sign the final contract and it's not more than three days after if you did, you are entitled to a full refund.

I'd call the B.B.B. and then contact the local TV news.
There is no reason that they should keep your deposit - especially if they sold the truck out from under you when you had a deposit on it.

why not start a new forum: dealers who are jack-holes/dealers who do what they can to do right.
after so many varifiable accounts of shiester-ism, a dealer gets black listed, or vice versa.
to use a hackneyed quip: money talks, everything else walks
as far as getting your money back, in addition to the good advice of everyone else, try some letters to the editor of some papers.
also, from listening to the tom martino (troubleshooter.com) show, i believe that texas has very good consumer protection laws, so a call to the state attorney generals' office might produce the result you want

and to answer one of your questions. no i did not order it. i saw it on ther lot and it had almost everything i wanted so i made a offer.
and they say the resone why they sold it was just because a new guy who didn't know the system sold it. but they also told me some guy from arkansaw or louisiana came in and bought it. so what i think is they guy offered more money for the truck and decided to screw me over they they can make a few extra bucks. they told me that they could get one just like it but it had cloth, and they said they could make it leather inside but it won't match.
not only did they loose my buisness but they also lost my dads who is planning on getting a new vette here really soon. and i hope nobody from this board will buy from them either. i want to hurt there buisness for what they are doing to me right now, and how crappy they have treated me.

The same sh!t happend to me. I went to stealership, location A, to look at truck on lot. Could not agree on price w/ trade-in so I left the lot (Manager was an @ss hole) Two days later I got a call from salesman #2 from same stealership, location B, he said that he could do better on the trade-in. I went to location B and worked a deal with salesman #2 filled out all the paperwork, signed the deal. Salesman #2 was going to have the truck delivered from location A to location B and I could pickup MY truck @2:00 pm that afternoon.
I arrived at the stealership a little after 3:00 pm and was informed that the @sshole at location A would not let location B have the truck. He said that it had already been sold the previous evening.
Now location B had to find me a truck, this was not an easy task. They searched for nearly 3 weeks before they found a truck in Clarksburg WV. They sent a flat bed pickup truck to go get the which "cost" them $1,000, and they wanted me to pay. Luckily they were able to get an additional $1,000 for my trade-in, so it was a wash. The new truck was approx $1,000 more than the one that I purchased, therefore we had to re-negotiate the sales price. What a pain in the @ss.
I do not begrudge someone to earn a few bucks . What I resent is the goddamn stress and hassle that people have to go through to buy a f'ing truck. We aren't buying a limited edition SCCA race ready Corvette, ITS A TRUCK, A WORK TRUCK. It is a shame, there are some honest dealerships, but most of therm are just muther fockers who treat honest people sh!t.
Sorry for the rant.

Here's is an approach that has never failed me. First fo all, you had a legally binding contract. Offer,acceptance, blah,blah.... Unless your agreement stipulated you take delivery the next day, they breached the contract, even if they provided a similar truck. The contract was for that truck, and the deposit is to show your good faith and for them to hold that truck until the financing and delivery can be done. If YOU breach the contract they can them keep the money. Providing a truck that is different probably would not be adequate performance on their part. I tell you this as jargon ammunition.
Go to them and tell them that they have a choice. They can refund the deposit or, they can pay their lawyers $150 - $200 per hour to defend a lawsuit and then refund your money with attorneys fees. The choice is theirs.
I recently had a body shop that would not repaint some bad work. I told them they could pay their paintman $15-20 per/hr or their lawyers 150 hr then their body man 15 an hr. They gladly repainted seeing as how I saved them so much money.
Go see Joe Orzo at Para, tell him you want to drive a Corvette. Go to the nearest gas station and with cell phone call and ask for your money or your keeping the corvette.

To hell with the "check in the mail" routine! Go down there and get it. It also helps to have a respectable (or as respectable as lawyers get) looking friend with a briefcase and a pinky ring go with you and say nothing, but write down a lot of names. Sometimes a scene in front of some potential customers goes a long way towards resolution of the problem. They can cut you a check right there. Be sure to name the dealership for our friends in Texas after all is said and done.

What is the Latest. Did you get your money back. I was sad to hear Frank Parra did this to you. I bought a brand new 96 corvette from them in 96. They were great then. But I would not even think of buying from them now.
